Terms of Service

These Terms of Service govern your use of bwabarrie.ca and any services provided by Barrie Workflow Automation ("we", "us", or "our"), a sole proprietorship operating in Barrie, Ontario. By using our website or engaging our services, you agree to these terms.

Our Services

Barrie Workflow Automation provides website design and development, workflow automation, and related digital services to small businesses primarily in Barrie and Simcoe County, Ontario. Specific deliverables, timelines, and pricing are agreed upon in writing before any work begins.

Payments

  • Build fees are invoiced before work begins. Work starts once payment is received.
  • Monthly fees are billed on a recurring basis from your launch date.
  • All prices are in Canadian dollars and subject to applicable HST (13%).
  • Invoices are due within 14 days of issue unless otherwise agreed in writing.
  • Late payments may result in a pause in service until the account is current.

Cancellation

You may cancel your monthly service at any time by providing written notice to james@bwabarrie.ca. Cancellation takes effect at the end of your current billing period. Build fees are non-refundable once work has commenced.

What You Own

Upon full payment, you own the website and all custom assets we create for you — design files, code, copy, and images (except stock photos, which are subject to their own licenses). We will provide all files upon request.

What We Need From You

To deliver your project on time, we need:

  • Timely feedback on drafts and designs (typically within 5 business days)
  • Content (text, photos, logos) by the agreed deadline
  • Access to any existing accounts we need to work with (hosting, domain, etc.)

Delays caused by missing content or feedback may push back your launch date. We'll always communicate clearly if this happens.

Revisions

All plans include a reasonable number of revisions during the build phase. We define "reasonable" as changes within the agreed scope — not a full redesign or change in direction mid-project. If scope changes significantly, we'll discuss the impact on timeline and cost before proceeding.

Third-Party Services

Some features of your website or automation may rely on third-party platforms (e.g., Google, form providers, booking tools). We are not responsible for outages, pricing changes, or policy changes made by those platforms. We'll always recommend reliable options and help you adapt if something changes.

Limitation of Liability

Barrie Workflow Automation is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including lost revenue, lost data, or business interruption. Our total liability for any claim is limited to the amount paid to us in the 3 months preceding the claim.

Intellectual Property

We retain the right to display work completed for you in our portfolio unless you request otherwise in writing. We will never share confidential business information.

Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario.

Changes to These Terms

We may update these terms from time to time. We'll notify active clients of material changes. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
